Fighting words doctrine
Well, I wanted to debate the constitutionality of the fighting words doctrine. For those of you who do not know what it is, it is a law prohibiting the use of offensive or annoying words when addressing another person in public.

You can indeed get arrested for this offense in the U.S.A., but, how do you think it should work. Should freedom of speech be entirely protected?

Should a persons rights only be infringed if their fist meets the other person's body? Or is it a good law, in terms of restraining idiots in real life?

Does this doctrine violate the first and fourteenth amendments?

Is the right of free speech absolute at all times and under all circumstances?

Are there certain "well-defined and narrowly limited" classes of speech that can be proscribed and regulated without constitutional problem?

I file this mentally in the "Don't shout fire in a crowded theater" mentality.

Any words that can cause direct or indirect harm or injury to you or others should not be allowed.

I agree with the doctrine, and am happy it is in place.

Given that the westboro baptist church's protests don't even fit this definition, and that it's been steadily retracted over the years, who cares?

I would be against it, but it's hardly enforced and people like the westboro baptist church really should be shut up.

In most cases foul words are harmless, but sometimes they can hit, hard. This should definitely be enforced, and thoroughly, at that.

irritating and unessesary, also pretty much impossible to enforce. It just annoys me that the government would even consider this

Unnecessary? Let's just take the Westboro Baptist Church, as stated previously. Sure, they're not acting on their profane racism and hatred(and selectively choosing certain parts of Biblic contradictions, but that aside), they're still REALLY messing with people's lives. An example would be how they protested homosexuality IN GENERAL outside of the funeral of a US soldier who was KIA, that's just plain fucked up.

More importantly, they could be spurring people to act on racist ideals(i.e. KKK).

Ignorance is bad, but it's worse when people act on it. Don't be that person, sid.

This just shows how fucked some of America's society is that they feel they need laws like this.

I know the term "common knowledge" and "good sense" get thrown around a lot, but really it should be both that you don't walk around using offensive words.

That is a different issue. You have to understand that America is a Christian nation, and so that kind of behaviour is seen as acceptable.

In fact in USA they have not allowed gay marriage just because in one passage of the bible it says to lay with another man is an abomination. Their religion is deeply ingrained in their country (hell, their motto is even "in God we trust", and their money and coat of arms is littered with religious iconography), so you should not take this kind of thing lightly, because their country is complex and devout.

It is similar to the Muslim countries that have strong religious laws. It would be wrong to tell them to change their law to make it go against their religion too.

Trust me, there's a difference between freedom of speech, and public slurs. Don't even compare the two.
The doctrine is just moral sense, though a bit impractical, due to happening in the public, somewhere, at my guess, every hour. Maybe if the person unfortunately stirred up trouble with that remark, which is the basic purpose of it. :|

You can never trust common sense when it comes to humans. Ever.

America may be predominantly Christian, but they don't stone gay people. The fact that they allow freedom of religion says enough.

The fact of the matter is that people shouldn't be allowed to slander other people in such a crude way, or else it could influence those without common sense to act upon this radicalism.

What happens when somebody (and there's a lot of candidates) DOESN'T exercise common sense and starts threatening people and making it seems as though the immediate surrounding area isn't safe? People are gonna panic, people may take extreme action that could cause harm to others.

Point: In a perfect world this wouldn't be needed.

Subpoint: The US being a Christian nation and gay marriage have nothing to do with this, at all.
