Sure you can use it just dont use his actual texture. And try to make it your own.

I mean he made his head tex with texture in the right corner.

Sure you can, but you can't steal his head if he has it, or just make a little edit too it.

Even small edits can be mistaken. I would say, you can use it as a reference as long as at least 20% of your head is different to his. Otherwise you could pm jepoay and ask If it's alright to have a simlar head.
